1. Acceptance of Terms

By downloading, installing, or using Baby Cry Analyzer ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Baby Cry Analyzer is an iOS application that uses machine learning to analyze baby cries and suggest possible reasons (hungry, tired, discomfort, etc.). The App:

• Processes audio recordings on your device using Apple's CoreML
• Provides suggestions based on cry patterns
• Offers 3 free analyses, then requires a one-time $2.99 purchase
• Does NOT diagnose medical conditions

3. License

3.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Baby Cry Analyzer for personal, non-commercial use on your iOS device.

3.2 Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App for commercial purposes
• Attempt to extract the machine learning model
• Share your purchase across multiple Apple IDs (except Family Sharing)
• Use the App in violation of applicable laws

4. Medical Disclaimer

You acknowledge and agree that:

• The App is for educational and informational purposes only
• Suggestions are based on patterns, not medical diagnosis
• You should always seek advice from a qualified healthcare provider
• The App may not accurately identify the reason for crying
• In case of medical emergency, call emergency services immediately
• We are not liable for any harm resulting from reliance on the App

4.1 When to Seek Medical Help

Seek immediate medical attention if your baby:

• Has a fever (especially if under 3 months old)
• Is lethargic or unresponsive
• Has difficulty breathing
• Shows signs of dehydration
• Has unusual or persistent crying (more than 3 hours)
• Shows any signs of serious illness

5. Pricing and Payments

5.1 Free Trial

• You receive 3 free analyses when you first download the App
• No credit card required for free trial
• Free analyses cannot be reset by deleting the app

5.2 In-App Purchase

• After 3 free uses, you must purchase "Unlimited Analyses" for $2.99 USD
• This is a one-time, non-consumable purchase (no subscription)
• Price may vary by country/region
• All purchases are processed through Apple's App Store
• Payment will be charged to your Apple ID account

5.3 Refunds

• All sales are final and processed through Apple
• Refund requests must be made through Apple (not us)
• Apple's refund policy applies: support.apple.com/HT204084
• We have no ability to issue refunds directly

5.4 Family Sharing

• The purchase may be shareable via Apple Family Sharing (if enabled)
• Subject to Apple's Family Sharing terms

6. Acceptable Use

You agree to use the App only for its intended purpose: analyzing baby cries. You may NOT:

• Use the App to analyze adult voices or other sounds
• Attempt to manipulate or game the free trial system
• Use automated tools to interact with the App
• Use the App in any way that violates laws or regulations

7. Intellectual Property

The App, including its code, design, machine learning models, and content, is owned by us and protected by:

• Copyright laws
• Trademark laws
• Trade secret laws
• Other intellectual property rights

All rights not expressly granted are reserved.

8. Privacy

Your use of the App is governed by our Privacy Policy, available at privacy.html. Key points:

• All cry analysis happens on your device
• We don't collect or store audio recordings
• Minimal data is stored locally for app functionality

9. Disclaimers and Limitations of Liability

9.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• No warranty of accuracy or reliability
• No warranty of merchantability
• No warranty of fitness for a particular purpose
• No warranty of non-infringement

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any indirect, incidental, special, or consequential damages
• We are NOT liable for any harm to you or your baby resulting from use of the App
• Our total liability shall not exceed the amount you paid for the App ($2.99 USD)
• We are NOT responsible for Apple's services or StoreKit functionality

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person

11. Changes to the App

We reserve the right to:

• Modify or discontinue the App at any time
• Update features, functionality, or design
• Change pricing for future customers (your purchase is honored)
• Require app updates to continue using the service

We will make reasonable efforts to notify you of material changes.

12. Changes to Terms

We may update these Terms from time to time. When we do:

• The "Last Updated" date will change
• We'll post the new Terms on this page
• For material changes, we'll show an in-app notification
• Continued use of the App means you accept the new Terms

13. Termination

13.1 By You

You may stop using the App at any time by deleting it from your device. This does not entitle you to a refund.

13.2 By Us

We may terminate your access if you:

• Violate these Terms
• Abuse the free trial system
• Engage in fraudulent activity

14. Third-Party Services

The App integrates with:

• Apple StoreKit: For in-app purchases (governed by Apple's terms)
• Apple CoreML: For on-device machine learning

We are not responsible for third-party services or their terms.

15. Governing Law

These Terms are governed by the laws of:

• Your country/state of residence, OR
• The jurisdiction where we are based (to be determined)

Any disputes shall be resolved in the appropriate courts of that jurisdiction.

16. Dispute Resolution

16.1 Informal Resolution

16.2 Arbitration (if applicable)

If we can't resolve the dispute informally, you agree to binding arbitration (except where prohibited by law).

16.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action (where permitted by law).

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
